联邦法院是政府决策机构中不可分割的一部分‐‐它不是在机械地解释法律。法官的裁决的确能够影响政治，反之亦然。那些将利益寄托在法官裁决上的人，试图说服法官接受他们的观点；那些在总统和国会那里没有如愿的人，希望能在法院这里达到目的。一些人把美国的司法体系叫作&ldo;后备立法机关&rdo;或&ldo;终极决定的国会&rdo;，因为它可以处理其他部门害怕的问题。没有最高法院的干预，国会不会通过公民权法案，总统也不会采取行动反对种族隔离政策。独立自主和拥有平等权力的司法机构，是美国对治理的重大贡献。这种司法权的路径正渐渐传播到世界各地，为法治和稳定的民主作出贡献。
